Head note

The subject of this study includes the interpretation of additional benefits and other commercial practices under the ECJ case-law in light of the Directive 2005/29/EC on unfair commercial practices.

Three key decisions of the ECJ are analyzed: 1. Total Belgium (combination of C-261/07 and C-299/07 cases), 2. Plus Warenhandelsgesellschaft (C-304/08 case, decision since 14.10.2010) and 3. Mediaprint (C-540/08 case, decision since 9.11.2010), which all lead to a radical change in the assessment of unfair commercial practices regarding the business to consumers’ relationship (B2C) by using three distinct methodological steps.

This endorsement modifies both the implementation of the general clause of Article 1 of Law 146/1914 (on the unfair competition) and the relevant provisions of the Law 2251/1994 on consumer protection. It results in a radical revision of the group of additional benefits and related commercial practices, which is considerably more liberal than the "paternalistic approach" adopted by the Greek law and the prevailing view in the theory.
