This article considers the harmonisation of EU competition law, in relation to both the UCP Directive and Rome II Regulation.
The article examines the provisions of the UCP Directive and finds that while the UCP Directive regulates business-to-consumer practices, business-to-business practices are left largely unregulated, threatening full harmonisation.
