This article is the second of a three part article on the Consumer Protection from Unfair Trading Regulations 2008, which implement the UCP Directive and substantially repeal the Trade Descriptions Act 1968.
This article focuses on the resulting statute and case law, specifically with respect to: (1) breach of professional diligence; (2) misleading actions; (3) misleading omissions; (4) offers to supply; (5) banned commercial practices; (6) misleading price indications; and (7) aggressive commercial practices.
The article includes a flow chart illustrating the elements of the misleading action and omission offences.
