This article considers that the Consumer Protection from Unfair Trading Regulations 2008 introduce three types of "prohibitions", including the general prohibition, misleading actions, omissions and aggressive commercial practices and a list of 31 specific practices. The article then discusses reg. 5 and its intention to ensure that the marketing of the product is conducted without causing an information asymmetry to the consumer. According to the author, the UK implementation of the UCP Directive is not entirely free from problems of interpretation, although interpretation issues can also be expected in other Member States.
