This article comments on the Queen's Bench Division ruling in Tiscali UK Ltd v British Telecommunications Plc on the interpretation of the Consumer Protection from Unfair Trading Regulations 2008 and the Business Protection from Misleading Marketing Regulations 2008, to allow the claimant to amend their claim to include the tort of interference with a business by unlawful means. According to the author, the decision by the judge to allow amendment of the claimant's case suggests that the Regulations may give competitors a mean to use them against competitors.
