Marketing Practises Act (2008:486)

4 § Annex I to Directive 2005/29/EC of the European Parliament and of the Council of 11 May 2005 concerning unfair business-to-consumer commercial practices in the internal market and amending Council Directive 84/450/EEC, Directives 97/7/EC, 98/27/EC and 2002/55/EC of the European Parliament and of the Council and Regulation (EC) No. 2006/2004(2) of the European Parliament and of the Council shall be Swedish law. The Government shall incorporate the annex at issue into the Swedish Code of Statutes. This Act shall apply in conjunction with an assessment of any of the provisions of Annex 1 to the Directive. The provisions of sections 1–31 of Annex I to the Directive shall apply notwithstanding that the marketing is directed to traders. The provisions of subsection 14 of Annex I to the Directive shall apply to measures which take place in contravention of that subsection unless the measure is governed by the Lottery Act (SFS 1994:100).
