42 - 45 § 42 § At the request of the Consumer Ombudsman: all parties shall be obliged to make a statement and provide necessary information in proceedings concerning the application of this Act; and a trader shall be obliged to provide such documents, samples of goods and suchlike as may be of significance for the investigation of a matter where it can be assumed that a decision concerning an injunction or order pursuant to sections 23, 24 or 25 will be at issue. 43 § A person who is subject to an injunction or order pursuant to sections 23, 24 or 25 shall be obliged, at the request of the Consumer Ombudsman, to provide such information, documentation, samples of goods and suchlike as are necessary in order to verify compliance with the injunction or order. 44 § Where necessary for insight into a proceeding referred to in section 42, subsection 2 or section 43, the Consumer Ombudsman may request a trader to make available for inspection such premises or comparable spaces where commercial operations are conducted. However, this shall not apply to residences. 45 § In the event of non-compliance with a request pursuant to sections 42, 43 or 45, the Consumer Ombudsman may order the person concerned to comply with the obligation, subject to payment of a fine.
