Federal Act amending the 1984 Federal Act against Unfair Competition

§ 14 (1) Any business operator manufacturing or marketing same or similar products or services (competitor), or associations promoting economic interests of business operators as far as they represent interests that are effected by said practices, may take legal action for cessation in contravention of §§ 1, 1a, 2, 2a, 3, 9a, 9c and 10. In the case of §§ 1, 1a, 2, 2a, 9a and 9c, the Federal Chamber of Employees (Bundeskammer für Arbeiter und Angestellte), the Austrian Chamber of Commerce (Wirtschaftskammer Österreich), the Presidential Assembly of Austrian Chambers for Agriculture (Präsidentenkonferenz der Landwirtschaftskammern Österreichs), the Austrian Trade Union (Österreichischer Gewerkschaftsbund) or the Federal Competition Authority (Bundeswettbewerbsbehörde) may additionally take legal action for cessation. In the case of aggressive or misleading practices according to § 1 Abs. 1 Z 2, Abs. 2 - 4, §§ 1a or 2, the action for cessation can also be enforced by the Consumers' Association Austria (Verein für Konsumenteninformation).
