Headnote

Making use of false claims in advertisements for electrical devices by stating that the use of such devices will lead to limited energy consumption and reduced electricity bills, is a misleading commercial practice.

Facts

 

The defendants used misleading statements in their advertisements published in the media, on the internet and in advertising leaflets, by alleging that the electrical devices which they promoted were able to limit energy consumption and reduce the electricity bills. 
 
However, a research conducted by the General Secretary of the Consumer established that there was in fact no reduction of the electricity bills achieved.

Legal issue

Does a reference in advertisements for electrical devices to limited energy consumption and reduced electricity bills constitute a misleading commercial practice, when it is established that there is no such limitation nor reduction?

Decision

It was held that the claims used by the traders for the promotion of these devices (i.e. limited energy consumption and reduced electricity bills) constituted unfair commercial practices.
