Fine Imposed for Resale Price Maintenance in Sale of Portable Navigation Devices

The Bundeskartellamt (BKartA) imposed on 12 May 2015 a fine of € 300 000 on United Navigation GmbH, Ostfildern (United Navigation), for enforcing resale price maintenance on retailers selling its products.

Fine for Vertical Agreement in Non-alcoholic Beverages Sector

On 3 March 2015, upon application of the BWB, the Cartel Court imposed a € 653 775 fine on Vöslauer Mineralwasser AG for vertical agreements fixing prices (RPM) with several retailers from January 2007 to December 2012 in the area of non-alcoholic beverages, especially mineral water (case 25 Kt 76/14). The agreements were found to infringe Article 101 TFEU and § 1 of the Austrian Cartel Act.

Fines Imposed for Resale Price Maintenance in Mattress Case

On 6 February 2015 the Bundeskartellamt (BKartA) fined Metzeler Schaum GmbH (Metzeler) € 3.38 million for imposing resale price maintenance on retailers selling its products.

The proceedings were initiated in response to complaints from within the market. As a result, in August 2011, the BKartA conducted dawn raids at various companies within the sector.

Fines for Various Food Retailers

On 26 November 2014, the Cartel Court imposed a € 3 000 000 fine on the retailer SPAR Österreichische Warenhandels AG for vertical price agreements (RPM) concluded with several suppliers from 2002 to 2012 in the area of dairy products, which were found to infringe Article 101 TFEU and the national corresponding provision (case 26 Kt 154/13).

Settlement with Dairy Producer

On 26 November 2014, the Cartel Court (29 Kt 60/14) imposed a fine of € 583.200 on NÖM AG, a major Austrian dairy producer for anticompetitive behaviour related to RPM with food retailers regarding certain dairy products between 2007 and 2012. The decision was taken in the framework of a settlement procedure.

Several food retailers and their suppliers are alleged to have infringed Article 101 TFEU and § 1 of the Austrian Cartel Act, by fixing consumer prices vertically and trilaterally and other proceedings are still pending.
