Laws

Law no. 46/86, of 14 October - (amended by the Law no. 115/97, of 19 September, and by the Law 49/05, of 30 August) – Comprehensive Law on the Education System – establishes the general Framework of the Education System.

Law no. 5/97, of 10 February - Pre-School Education Framework Law, which sets out the legal framework for developing and expanding pre-school education.

Law no. 3/2002, of 20 December – approves the evaluation system for non higher education, developing the regime foreseen in the Law no. 46/86, of 14 October (Comprehensive Law on the Education System).

Law no. 37/2003, of 22 August - establishes the criteris for higher education funding. 

Law no. 49/2005, of 30 August – second amendment to the Comprehensive Law on the Funding of Higher Education.

Law no. 23/2007, of 4 July – approves the legal framework of entry, permanence, exit and withdrawal of foreigners from the national territory.

Decree-Law no. 67/2005, of 15 March – regulates the recognition by the Portuguese State of academic degrees following the successful completion of a Master's degree in the scope of Erasmus Mundus.

Decree-Law no. 121/2005, of 26 July - third amendment to the Career Statute of nursery teachers and teachers in primary and upper-secondary education, approved by Decree-Law no. 139-A/90, of 28 April, and establishes measures regarding some statutory aspects relating to teaching.

Decree-Law no. 229/2005, of 29 December - revises the systems which determines which groups subscribing to the CGA are exceptions to the rules laid down by the Retirement/Pension Statute regarding length of service, retirement age and pension calculation formula, in order to make them compatible with the public service system of social protection that converges with the general social security scheme, in relation to retirement conditions and the calculation of pensions.

Decree-Law no. 20/2006, of 31 January - revises the legal framework of the competitive procedure for the selection and recruitment of teaching staff in pre-primary, basic and upper-secondary education, repealing Decree-Law no. 35/2003, of 27 February.

Decree-Law no. 27/2006, of February 10 - creates and defines the  recruitment groups for the selection and recruitment of teaching staff of pre-school, primary and secondary education.

Decree-Law no. 39/2006, of 20 February – creates the National Vocational Training Council, which replaces the National Advisory Council for Vocational Training, revoking Decree Law no. 308/2001, 6th December.

Decree-Law no. 64/2006, of 21 March – establishes special conditions of access and entry in higher education, in particular for students aged over 23.

Decree-Law no. 74/2006, of 24 March – new legal regime for higher education degrees and diplomas (in accordance to the Bologna Process). 

Decree-Law no. 88/2006, of 23 May – regulates Technological Specialization Courses (CET) and applies to all institutions offering these types of courses.

Decree-Law no. 15/2007, of 19 January – introduces amendments to Teaching Career Statute of pre-primary, basic and secondary teachers, approved by Decree-Law no. 139/-A/90, of 28 April, and amends the legal regime for Continuous professional development of teachers, approved by Decree-Law no. 249/93, of 9 November; creates the Scientific Council for Teacher Evaluation.

Decree-Law no. 43/2007, of 22 February - approves the legal framework of the professional qualification for teaching in pre-primary, primary and upper-secondary education.

Decree-Law no. 276-C/2007, of 31 July – approves the Organic Law of the National Agency for Qualification, I.P..

Decree-Law no. 309-A/2007, of 7 September - creates a specific system of loans with mutual guarantee, for students and scholarship holders of Higher Education, researchers and scientific research and technological development institutions.

Decree-Law no. 341/2007, of 12 October – establishes a new system for the recognition of foreign degrees of identical level, goals and nature to the degrees of bachelor, master and PhD assigned by Portuguese higher education institutions.

Decree-Law no. 357/2007, of 29 October – regulates the process of completion and certification of adults with incomplete educational pathways at secondary level and developed under study plans already extinct.

Decree-Law no. 369/2007, of 5 November – in accordance to Decree-Law no. 74/2006, of 24 March, creates the Agency for Assessment and Accreditation of Higher Education - A3ES – entity responsible for the assessment and accreditation of Higher Education Institutions and their cycles of studies, in order to promote quality assurance in higher education.

Decree-Law no. 396/2007, of 31 December – establishes the legal framework of the National Qualifications System and defines the structures that regulate its operations.

Decree-Law no. 3/2008, of 7 January – defines specialized support to be provided in pre-school, basic and secondary education, in the public, private and cooperative sectors, in order to create adequacy conditions regarding the educational process to special educational needs of students with permanent limitations. 

Decree-Law no. 37/2008, of 5 March –  regulates the public Military and Police Higher Education Institutions.

Decree-Law no. 75/2008, of 22 April - (amended and republished by the Decree-Law no. 137/2012, of 2 July) approves the regime of autonomy, administration and management of public establishments of pre-school, basic and secondary education.

Decree-Law no. 90/2008, of 30 May – aims to introduce certain changes in the general access and enrolment system in higher education.

Decree-Law no. 107/2008, of 25 June - (amended Decree-Law no. 67/2005, of 25 March and Decree-Law no. 74/2006, of 24 of March) aims to promote the development of the Bologna Process in Higher Education and further simplification and streamlining of procedures for requesting authorization to provide courses, introducing measures to ensure more flexibility in access to this level of education, creating the status of student in part-time, allowing enrollment  in individual curricular units/courses, by students and non students, supporting and simplifying the process of proving the ownership of degrees and diplomas.

Decree-Law no. 51/2009, of 27 February - implements the second amendment to Decree-Law no. 20/2006, of 31 January, which revised the legal framework of the competitive procedure for selection and recruitment of teaching staff in pre-primary, primary and upper-secondary education, as well as special education, and which repealed Decree-Law no. 35/2003, of 27 February.

Decree-Law no. 270/2009, of 30 September - implements the ninth amendment to the Career Statute of nursery teachers and teachers in primary and upper-secondary education, approved by Decree-Law no. 139-A/90,  of 28 April, the third amendment to the Decree-Law no. 20/2006, of 31 January, and the first amendment to Decree-Law no. 104/2008, of 24 June.

Decree-Law no. 75/2010, of 23 June – amends the Teaching Career Statute of pre-primary, basic and secondary teachers, approved by Decree-Law no. 139-A/90, of 28 April and subsequent legislation on teacher performance appraisal.

Decree-Law no. 36/2012, of 15 February – approves the structure of the Agência Nacional para a Qualificação e o Ensino Profissional (National Agency for Qualification and Vocational Education and Training) of the Ministry of Education and Science.

Decreew-Law no. 41/2012, of 21 February - proceeds to 11ª amendment of the Statute of Career of the Teaching Career Statute of pre-primary, basic and secondary teachers, approved by Decree-Law no. 139/-A/90, of 28 April.

Decree-Law no. 42/2012, of 22 February – changes the system that establishes the upper-secondary final grade of science-humanities course in recurrent education for the purpose of further study. This is the fifth amendment to Decree-Law no. 74/2004, 26th March, which establishes the guiding principles of how the curriculum is organised and managed, as well as how learning is assessed in upper-secondary education.

Decree-Law no. 48/2012, of 29 February – approved the organic structure of the Directorate-General for the Qualification of Public Workers (INA).

Decree-Law no. 49/2012, of 29 February – approves the organisational structure of the Social Services of the Public Administration (SSAP).

Decree-Law no. 132/2012, of 27 June - establishes the new teaching staff recruitment and mobility system in basic and upper-secondary education and of trainers and specialised professional.

Decree-Law no. 139/2012, of 5 July – establishes the guiding principles for the organization and management of curricula, assessment of knowledge and skills to be acquired and developed by pupils at basic and secondary education. 

Decree-Law no. 150/2012, of 12 July – proceeds to the third amendment to the Decree-Law no, 4/98, of 8 January, which establishes the creation, organization and functioning of schools and vocational courses, in the scope of non higher education.

Decree-Law no. 176/2012, of 2 August – regulates the regime of enrolment and attendance in the scope of compulsory education, of children aged between 6 and 18 years old. 

Decree-Law no. 246/2012, of 13 November – proceeds with the first amendment to Decree-Law no. 86 -A/2011, of 12 July, which approves the Organic Law of the 19th Constitutional Government of Portugal.

Decree-Law no. 266-G/2012, of 31 December – proceeds with the first amendment to Decree-Law no. 125/2011, of 29 December, which approves the Organic Law of the Ministry of Education and Science.

Decree-Law no. 91/2013, of 10 July – proceeds with the first amendment to Decree-Law no. 139/2012, of 5 July, which establishes the guiding principles for the organisation and management of the curricula for basic [year 1 to year 9] and secondary [year 10 to year 12] education, for the evaluation of the knowledge to be acquired and the skills to be developed by students, and for the curriculum development process in basic and secondary education.

Decree-Law no. 102/2013, of 25 July – creates the Institute of Educational Assessment, I.P., (IAVE, I.P.), which succeeds the Assessment Office.

Decree-Law no. 115/2013, of 7 August - amends and republishes Decree-Law no. 74/2006, of 24 March, which approves the legal framework of higher education degrees and diplomas.

Decree-Law no 22/2014, of 11 February  - establishes the legal regime for teachers' continuous training and defines the respective system for coordination, administration and support.

Decree-Law no. 36/2014, of 10 March – regulates the international student statute, as mentioned in no. 7 of article 16 of Law no. 37/2003, 22nd August, which establishes the criteria for higher education funding.

Decree-Law no. 43/2014, of 18 March - creates Professional Higher Education Technical Programmes, as a short-cycle higher education training, non-degree awarding. 

Decree-Law no. 79/2014, of 14 May – approves the legal framework for teaching qualifications in pre-school, basic and secondary education.

Decree-Law no. 83-A/2014, of 23 May - makes the third amendment to Decree-Law no. 132/2012 of 27 June, which establishes the new teaching staff selection, recruitment and mobility system in pre-school, basic and upper-secondary education establishments overseen by the Ministry of Education and Science.

Decree-Law no. 113/2014, of 16 July - regulates the higher education special admissions system. 

Decree-Law no. 176/2014, of December 12 - determines the introduction of English as a compulsory subject from  3rd grade and defines the professional qualification to teach English at 1st cycle, creating a new group of recruitment.

Decree-Law no. 21/2015, of 3 Febuary - approves the organisational structure of the National Council of Education (CNE - Conselho Nacional de Educação).

Rectification statements no. 59/2012, of 12 October - Amends Ordinance no. 243-A/2012, of 13 August that defines the system of organisation and operation, assessment and certification of the course in Communication Design, Product Design and Artistic Production in the Visual Arts and the Audio-visual Communication course in the audio-visual area, taught in public, private and cooperative education institutions.

Rectification Declaration no. 669/2012, of May 23 - rectifies Dispatch no. 5306/2012, of April 18, namely paragraph c) of Article 3, and Article 6, 12 and 14.

Resolutions of the Council of Ministers

Resolution of the Council of Ministers no. 173/2007, of 7 November – approves a set of measures in relation to vocational training reforms agreed with the majority of social partners who are members of the Standing Committee on Social Dialogue.

Resolution of the Council of Ministers no. 97/2010, of 14 December – defines a set of multiannual measures distributed by five strategic axis: axis no. 1 “Disabilities and multiple discrimination”; axis no. 2 “Justice and exercise of rights”; axis no. 3 “Autonomy and quality of life”; axis no. 4 ”Accessibilities and design for all”; axis no. 5 “Administrative Modernization and Information Systems”. These measures aim to promote rights and ensure decent living conditions to people with disability with view of their prevention, qualifications, rehabilitation and participation.

Resolution of the Council of Ministers no. 51-A/2012, of 14 June – approves the Youth Employment Promotion Initiatives and Support for Small and Medium-sized Companies Strategic Plan - «Impulso Jovem».
