At the level of legislative and administrative power, the Riigikogu (Parliament), the government of the Republic of Estonia and the Ministry of Education and Research administer education system. A county, a local government and educational institutions have their specific roles in administering education system.
The Riigikogu has the exclusive authority to:

  • determine the principles of the formation, functioning and development of the education system;
  • establish tuition fees for public educational institutions and universities in public law;
  • decide on the establishment, merger, division and termination of the activities of  universities in public law.

The Government of the Republic has the authority to:

  • adopt national education development programs and provide guarantees for their implementation;
  • establish the procedure for the establishment and reorganisation of public educational institutions and for termination of their activities, and to approve  the statutes of state institutions of professional higher education;
  • establish the statutes of state owned educational institutions;
  • establish the rates of tuition fees, study loans, scholarships and other state support as well as the terms and conditions for granting them;
  • establish the basis for remuneration for the work of teachers; 
  • establish national curricula, the higher and vocational education standards and framework requirements for teacher training.

The main function of the Ministry of Education and Research  is to ensure targeted and effective development of education, research, youth and language policy, and a high level and competitiveness of research and development.

The Ministry of Education and Research administers the planning of education, research, youth and language related national policies and, in conjunction thereof, managing the fields of preschool, basic, general upper secondary, vocational secondary, higher, hobby and adult education, organising research and development activities, youth work and special youth work, and compiling drafts of corresponding legal acts. 
For the achievement of its objectives, the ministry shall:

  • plan, organise and develop education, research, youth and language policy; 
  • develop national development plans in the areas of education, research, youth and language policy and ensure the compliance thereof with national and sectoral development plans; organise funding and implementation of development plans, and assessing the outcomes thereof; 
  • exercise state supervision over teaching and education in educational institutions and the performance of national curricula and other educational standards;
  • plan, develop national curricula and other educational standards and organise development and accreditation thereof.  

The Ministry of Education and Research is managed by the Minister, the Secretary General, the Manager for School Network Development and four deputy secretary generals: Deputy Secretary General for Higher Education and Research, Deputy Secretary General for Youth Affairs and International Relations, Deputy Secretary General for General and Vocational Education and Deputy Secretary General for Planning.

The Internal Audit Department is directly subordinated to the Minister, the Personnel Department, the Communications Department and the Legal Affairs Department are subordinated to the Secretary General. The School Network Department is subordinated to the Manager for School Network Development.

The area of responsibility of the Deputy Secretary General for Higher Education and Research includes the Higher Education Department and the Research Policy Department. The European Union and International Cooperation Department, the Language Policy Department and the Youth Affairs Department are directly subordinated to the Deputy Secretary General for Youth Affairs and International Relations; the Vocational Education Department, the Adult Education Department, the General Education Department, the External Evaluation Department and the Teacher Department are directly subordinated to the Deputy Secretary General for General and Vocational Education. The Analysis Department, the Financing Department, the State Assets Department, the Structural Funds Department, the Administrative Department and the E-Services Department are directly subordinated to the Deputy Secretary General for Planning. 

The personnel of the Ministry also includes the Minister's advisers and advisers of the Ministry, who are subordinated to the Secretary General or the deputy secretary generals. The main task of the Language Inspectorate, which is in the area of government of the Ministry of Education and Research, is exercising supervision over compliance with the Language Act and other legal acts regulating the use of language.

In the area of government of the Ministry of Education and Research there is the Language Inspectorate, the main task of which is exercising supervision over compliance with the Language Act and other legal acts regulating the use of language, and the National Archives of Estonia, the task of which is to guarantee conservation of documented heritage, and Estonian Youth Work Centre.

The county governor, who has been granted the task of state supervision over teaching and education activities, in correspondence with the Preschool Child Care Institutions Act and the Basic Schools and Upper Secondary Schools Act, participates in the management of the education system on regional level. The county governor (with the help of county governments' education and culture departments), appointed for the task by the Minister, exercises thematic supervision deriving from the priorities of state supervision over childcare institutions and schools. The task of the county is to prepare county development plans that include an education development plan. A county also has its role in organising contests, standard-determining tests, basic school final examinations and upper secondary school state examinations.
