Product Market Withdrawal The products hereunder are subject to the provisions of Commission Implementing Decision (EU) 2019/1562 of 16 September 2019 amending Decisions 2007/305/EC, 2007/306/EC and 2007/307/EC as regards the tolerance period for traces of Ms1×Rf1 (ACS-BNØØ4-7×ACS-BNØØ1-4) hybrid oilseed rape, Ms1×Rf2 (ACS- BNØØ4-7×ACS-BNØØ2-5) hybrid oilseed rape and Topas 19/2 (ACS-BNØØ7-1) oilseed rape, as well as their derived products The presence of material which contains, consists of or is produced from ACS-BNØØ4-7, ACS-BNØØ1-4 and the hybrid combination ACS-BNØØ4-7×ACS-BNØØ1-4 oilseed rape in food or feed products notified under point (a) of Article 8(1) and Article 20(1) of Regulation (EC) No 1829/2003 shall be tolerated until 31 December 2022, provided that this presence:
(a) is adventitious or technically unavoidable; and
(b) is in a proportion no higher than 0,1 % mass fraction.

1.) Processed oil from genetically modified oilseed rape seed derived from:

a) the male sterile MS1Bn (B91-4) oilseed rape line and all conventional crosses
b) the fertility restorer RF1Bn (B93-101) oilseed rape line and all conventional crosses
c) the hybrid combination MS1xRF1 (ACS-BNØØ4-7xACS-BNØØ1-4)

notified as existing food falling within the scope of Article 8(1)(a) of Regulation (EC) No 1829/2003, which is produced from a genetically modified organism (GMO) and which have been placed on the market in accordance with Art. 5 of Regulation (EC) No 258/97, notification forwarded to Member States on 24/06/1997, opinion on substantial equivalence by the UK Advisory Committee on Novel Foods and Processes, confirmation by the UK Ministry of Agriculture, Fisheries and Food on 12/05/1997.

2.) Oilseed swede-rape1 derived from

a) the male sterile MS1 (B91-4), cultivar Drakkar, oilseed rape line (Brassica napus L. oleifera Metzg.)
b) the fertility restorer RF1 (B93-101), cultivar Drakkar, oilseed rape line (Brassica napus L. oleifera Metzg.)
c) the hybrid combination MS1xRF1 (ACS-BNØØ4-7xACS-BNØØ1-4) (Brassica napus L. oleifera Metzg. MS1Bn x RF1Bn)

for the use of growing for obtaining seed but not for the use for human food or animal feed

for the intended uses of growing and handling in the environment before and during processing to non-viable fractions

Decision to grant consent: 97/392/EC (OJ L 164, p. 38 - 39 - 21/06/1997),

notified as existing feed falling within the scope of Article 20(1)(a) of Regulation (EC) No 1829/2003, which consists of and/or contains a genetically modified organism (GMO) and which has been placed on the market in accordance with Part C to the Directives 90/220/EEC.

(1) The scope covers any progeny derived from crosses of the product with any traditionally bred swede-rape.

* The authorising decision under Directive 90/220/EEC covers the seeds of hybrid swede-rape (Brassica napus L. oleifera Metzg.) derived from crosses using: (a) the progeny of the male sterile swede-rape line MS1 (B91-4) cultivar Drakkar and (b) the progeny of the fertility restoration swede-rape line RF1 (B93-101) cultivar Drakkar. Seeds for further food and feed use are included in the notification in accordance with Article 8(1)(a) / Article 20(1)(a) of Regulation (EC) No. 1829/2003 and as referred to in Article 11 of Regulation (EC) No. 641/2004. Designation Hybrid swede-rape (Brassica napus L. oleifera Metzg.) derived from crosses using:

a) the progeny of the male sterile swede-rape line MS1 (B91-4) cultivar Drakkar containing the barnase gene from Bacillus amyloliquefaciens coding for ribonuclease, the bar gene from Streptomyces hygroscopicus coding for Phosphinothricin Acetyltransferase, the neo gene from Escherichia coli coding for Neomycin Phosphotransferase II, the promoter PSsuAra from Arabidopsis thaliana, the promoter PNos from Agrobacterium tumefaciens, the promoter PTA29 from Nicotiana tabacum, and b) the progeny of the fertility restoration swede-rape line RF1 (B93-101) cultivar Drakkar containing the barstar gene from Bacillus amyloliquefaciens coding for ribonuclease inhibitor, the bar gene from Streptomyces hygroscopicus coding for Phosphinothricin Acetyl Transferase, the neo gene from Escherichia coli coding for neomycin Phosphotransferase II, the promoter PSsuAra from Arabidopsis thaliana, the promoter PNos from Agrobacterium tumefaciens, the promoter PTA29 from Nicotiana tabacum.
Method for detection - Event-specific real time quantitative PCR detection for MS1, RF1, MS1xRF1 oilseed sweet-rape.
